I was run off the road in November 2017 by a driver I believe was either drunk or texting. He was deemed at fault. My SUV was hit badly on the driver's side door sending me flying over a curb and up a slight hill, thankfully my airbags did not go off or I would not have been able to avoid hitting not only a bus stop pole but an electrical pole as well. My car axle bent on the passenger side as well and the front bumper fell off and I was left trapped in my truck because the door was stuck causing $9000.00 in damage. Although my SUV was a 2004, anyone who knows me will tell you I take exceptional care of my vehicles and I keep them for a long time because I am a single mom on a single income with a mortgage. They deemed my truck right off. I had a rental car set up immediately on the Monday following the accident. It took the Insurance company over a month to send someone out to the Body shop to assess the truck and the only reason why they finally did is because I called to complain. Right after my Phone call on December 21st, I get a call offering me $2400.00 plus tax minus 1000.00 but plus 1000.00 because as he quoted "your vehicle was in above average condition for its year" deductible because the other parties insurance company was claiming he was not at fault despite the police report I submitted. I disputed the amount and questioned the deductible. The Adjuster told me he would need the full disclosure from the police report and asked me to go to request it because it would be faster. I went On December 22nd all the way downtown, $27.00 parking and $67.00 for the report which they said they would mail in 2-3 weeks. I called the adjuster and told him and he then told me I had to return the vehicle on December 27th as my time was up, I said I couldn't A) because I needed a vehicle to get around and B) it was the Christmas Holidays and there would be no time for me to go find a car in such a short time, furthermore, for my religion and ethnic background we celebrate the entire week. He extended it up to January 2nd only and I said I wanted a manager to call me back. I indicated that they still have not received police report and if they had gone to appraise my vehicle sooner I would not be in this situation. On January 2nd I received the police report in the mail, I faxed it to him immediately. I received a return call about a week later indicating there would not be a deductible because I was not at fault. I had sent him 3 estimates as I had gone out to try to find a replacement vehicle and I had actually gone to look at 2004 GMC Envoy like mine. None were in any way, shape, or form in the as he put it "above average condition" that mine was in nor did they have the full FUNCTIONING options that I had in mine. The prices ranged from 6700.00 to 7800.00. I asked the insurance to at least give me the 7800.00 or to meet me in between. The adjuster said no and then I spoke to his manager who was a horrible person. She basically said that they obtained their quotes from the Auto trader and I said so did I but I went to physically see and test drive these vehicles whereas they did not. She basically told me: "Too bad we are not here to put you in the same position that you were in prior to the accident we can only replace the value as we see it". I argued with her but to no avail. She backdated the cut off date to the rental to January 9th and I am now in collections with Enterprise Rentals for 4 days worth of rental costs and have been without a car since then. I refuse to settle with them because I know what the value of my truck was and if I had not gone to physically see and test drive the vehicles I would have settled for their offer but their offer will not put me into a reasonable vehicle that I can keep for a few more years. I had no intentions of buying a new car for the next 4-5 years. Royal Sun Alliance is the worst insurance company. The gentleman that hit my truck received far better service from Intact Insurance and he was at fault. I will never use this company again.
